1. GENERAL
1.1 These conditions of sale and delivery apply to the sale and delivery of the products offered on this website. Please read all the conditions of sale and delivery carefully before ordering a product on this website. By ordering one of our products, you automatically accept the provisions described below.

2. YOUR STATUT
2.1 If you order an item on our website, you guarantee that the following conditions are met:

- You are a natural person and you purchase the products for non-commercial purposes
3. PURCHASE OF GOODS, ORDER PROCESSING
3.1 Ordering a product on this website is considered an offer to purchase a product in accordance with these conditions of sale and delivery.
3.2 After placing an order, you will receive a confirmation to your email address stating that we have taken note of your order. We would like to inform you that this does not in any way mean that your order has been accepted.
3.3 If the products ordered are not available, you will be informed by email. You will then have the choice of waiting until the item is available again or canceling the order.
3.4 Orders are subject to approval by EQUUS, which reserves the right to ask you for additional information (for example proof of identity).
3.5 We confirm acceptance of your order by sending you an order confirmation by email. Subject to art. 3.4 above, this results in a legally binding contract between both parties.
3.6 This contract only concerns products for which we have confirmed delivery in the order confirmation document. We are not obliged to deliver any other products which may be part of your order, unless delivery of these products has been confirmed in a separate order confirmation.
4. PRICE AND PAYMENT
4.1 The price of a product corresponds to the respective data indicated on the website. VAT (percentage currently in force) is included in the prices indicated. Standard delivery costs are included in the price.
4.2 We are not required to deliver a product to you at an incorrect price (lower price), if the price error is obvious and you could easily have detected the fact that the price indicated was incorrect, even if we have already sent you an order confirmation with the incorrect price.
4.3 Payment can be made with the credit or debit cards described in the order process. We will indicate the amount to be paid in the order confirmation. Payment must be made before delivery of the products. We debit the amount due from your bank account when ordering. We have the right to postpone delivery of the products until we have obtained full payment for the products ordered.
4.4 All credit card holders are subject to a validity check carried out by the card issuer who must, in addition, authorize the holder to use the card. Personal data of the credit card holder which is necessary for checks may be exchanged with third parties. If the credit card issuer does not authorize payment, we cannot be held responsible for the delay or non-delivery of the order.
5. DELIVERY
5.1 We will send you information and a link to Track&Trace of Poste CH SA. Delivery will in principle be made within 1 to 3 days (Switzerland), 2 to 5 days (Europe), 3 to 10 days (Rest of the world), from the date of the order, if nothing else has not been explicitly agreed at the time of execution of the order.
5.2 The delivery address corresponds to the data indicated in the order confirmation.
5.3 If we are unable to meet the defined delivery time and the new delivery date cannot be established within 30 days after the order date, we will immediately contact you to inform you of the new date. 6. TRANSFER OF RISKS AND OWNERSHIP
6.1 The product becomes your property as soon as payment of the total purchase price has been made in full or delivery of the product has been made, whichever comes first. 7. RIGHT OF WITHDRAWAL
7.1 You have a right of withdrawal which you can exercise, without having to justify the reason, by making the request from our website within a maximum period of 7 days from receipt of the product concerned. The right of withdrawal does not apply to products that are tailor-made or clearly personalized. Each returned product must be in its original packaging, accompanied by the delivery note and all accessories received. Once the package has been received by our services, you will be informed by email of the processing of your return.
7.2 If the withdrawal is carried out within the deadline, the aforementioned conditions are respected and the product which reaches us has neither been worn nor used, it is not damaged and/or soiled, it is in its original packaging and accompanied by the delivery note and all accessories received, EQUUS will reimburse you the price invoiced within 14 days of receipt of the product, by recrediting the account corresponding to the credit card/ flow rate used.
7.3 If you have returned a product to us because it was delivered incomplete, damaged, defective or non-compliant and you wish to be refunded, EQUUS will refund the invoice price within 14 days of receipt of the product , by re-crediting the account corresponding to the credit/debit card used, and after our quality control department has inspected the product to verify that it complies with the conditions referred to above.
7.4 If you have returned a product to us because it was delivered incomplete, damaged, defective or non-compliant and you wish to have the said product replaced, a new shipment will be made within 14 days of receipt of the product. product or the proof(s) of its shipment that you have sent to us, and after our quality control department has inspected the product in order to verify that it complies with the conditions referred to above.
8. WARRANTY
8.1 If the product is damaged or an imperfection of any kind is noted, EQUUS will repair the product immediately – after assessment – or will deliver a replacement product to you, once the damaged or defective product has been received by the company.
8.2 Watch Warranty: All watches offered for sale on this website are provided with a 24-month international warranty against defects in material or workmanship. The general conditions regarding the guarantee appear on the guarantee certificate supplied with each watch.
8.3 Warranty requests must be made to an approved EQUUS representative or by returning the product to the EQUUS company. A part must be attached to the warranty request on which the date of purchase or delivery is indicated. The following items are accepted as proof of purchase:
- An original invoice or the original delivery note,
- A bank statement or credit card statement.
8.4 This warranty in no way limits subsequent warranty claims and the right to reductions, withdrawals or damages, which legally accrue to the buyer.
9. LIABILITY
9.1 EQUUS is liable for damages in connection with warranty or other legal bases – in particular claims relating to unlawful acts, organizational faults, faults committed during the conclusion of the contract or rights possible losses linked to other faults following a breach of duty – only if it is proven that EQUUS or its auxiliaries committed criminal intent or gross negligence or that the damage is linked to product liability law. The exclusion of liability in the event of simple negligence is not valid for damages relating to harm to life, physical injury or health, the same applies in the case of willful concealment of defects. In the above-mentioned cases, EQUUS also assumes liability for minor acts of negligence committed by its legal representatives or auxiliaries.
10. MISCELLANEOUS
10.1 Transfer of rights and charges. The contract established between you and us is considered to be binding on you and us, as well as on our respective beneficiaries. You may not transfer, assign, encumber or otherwise dispose of the right to deliver the goods ordered and defined in this contract, without having obtained our prior written consent.
10.2 Saving clause. If certain provisions of these conditions of sale are partially or completely ineffective, the effectiveness of the other provisions remains valid.
10.3 Electronic Communication. By browsing our website, you accept that communication – in accordance with current legislation – is carried out electronically. We will contact you via your email address or by post to the address you provided to us.

10.5 Jurisdiction applicable law. To the extent legally permissible, Bienne (CH) is the exclusive legal venue for all disputes relating to these conditions of sale and delivery. EQUUS is also entitled to take legal action before the competent court of the customer's domicile.
10.6 These conditions of sale and delivery are subject to Swiss law, excluding conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is not applicable.
